A. GENERAL / SYSTEM ISSUES

1. I tried emailing myehs@doe.gov.my but received an error saying the address could not be found.
DOE will bring this matter to the attention of the IT Division and will inform users once it is resolved.

B. STOCKHOLM CONVENTION STATUS IN MALAYSIA

2. Has Malaysia ratified the Stockholm Convention?
No. Malaysia has signed but has not yet ratified the Stockholm Convention. Signing and ratifying are two different processes.

3. Does this mean enforcement has not started?
Malaysia is not legally bound by the Convention; however, chemicals listed under Annex A, B, and C of the Stockholm Convention are included in the EHS Reference List in MyEHS, and regulatory controls are applied through MyEHS.

4. Is there a timeline for ratification?
There is currently no confirmed timeframe. Ratification will proceed once a national regulation covering downstream chemical management is in place. The regulation is under development and in its final stages.

C. REGULATORY STATUS OF UV-328 & DECHLORANE PLUS

5. Are UV-328 and Dechlorane Plus banned in Malaysia?
Malaysia follows the Stockholm Convention guidelines. Import, export, production, and use of UV-328 and Dechlorane Plus are not allowed, except for specific exemptions under the Convention.

6. Can exemptions be applied in Malaysia?
Exemptions under Article 4 of the Stockholm Convention must be registered with the Secretariat. As Malaysia has not ratified the Convention, Malaysia has no plans to register any exemptions at this time.

7. When were UV-328 and Dechlorane Plus added to Annex A?
They were added following decisions at Stockholm Convention COP-11 (May 1–12, 2023).

8. Are they already included in the MyEHS EHS Reference List?
They will be updated in the MyEHS EHS Reference List in the near future following Annex A inclusion.

9. Once included, do they need to be registered?
Yes. Once listed, they must be registered and notified through MyEHS.

D. IMPORT & EXPORT OF POPS (UV-328 / DECHLORANE PLUS)

Import into Malaysia

10. Does the ban apply to imports of products containing trace amounts of these chemicals (e.g. finished electronics)?
DOE does not directly control finished products containing EHS. These are under the jurisdiction of Royal Malaysian Customs Department (JKDM) / MITI.
However, importers/exporters must notify DOE via MyEHS, after which DOE will issue a comment letter for Customs’ consideration.

11. Is an Import Certificate required for products containing trace amounts?
Import certificates apply to bulk chemicals. Products containing EHS require notification, not licensing.

Export from Malaysia

12. Can Malaysia export POPs to other countries?

Exporting to Stockholm Convention Party countries may be restricted.
Party countries generally cannot import POPs from non-Party countries, except under specific conditions.
Exporting to non-Party countries may proceed according to JKDM procedures.

E. FINISHED PRODUCTS & TRACE AMOUNTS

13. If a finished product contains trace amounts of Dechlorane Plus or UV-328 and no SDS is available, what documents are acceptable?
Any certificate or document confirming the presence of the chemical may be uploaded (e.g. supplier declaration, technical datasheet).

14. What if the company is unaware that a finished product contains POPs?
DOE acknowledges this challenge. DOE relies on technical guidance from the Stockholm Convention Secretariat that identifies products likely to contain POPs.
Cooperation from industry is essential for effective monitoring and compliance.

15. Are manufacturers required to register if POPs are only present in components or finished products?
Registration is required only if the company imports, exports, or manufactures the chemical substance or mixtures.
It does not apply to finished products containing the substance.

F. MyEHS REGISTRATION & OBLIGATIONS

16. Is MyEHS registration mandatory?
Yes, for importers, exporters, and/or manufacturers of EHS substances listed in the MyEHS scope.

17. What is the difference between Register, Apply, and Notify in MyEHS?

REGISTER
Company registration in MyEHS (ROC number required).
APPLY
Submission of regulatory applications (e.g. Explicit Consent, Export Notification).
NOTIFY
Disclosure of chemical details (CAS No., tonnage, hazard data). This supports DOE’s inventory, prioritisation, and risk assessment.

G. ANNUAL CERTIFICATION REQUIREMENT

18. Is any documentation required if importing Annex A or B chemicals?
Yes. Companies intending to import such chemicals must submit an Annual Certification to DOE using the prescribed form.

H. GUIDANCE & FURTHER ASSISTANCE

19. Which authority handles production and occupational use matters?
The Chemical Management Division, Department of Occupational Safety and Health (DOSH).

20. Can further clarification be discussed directly with DOE?
Yes. Stakeholders are encouraged to arrange meetings with DOE (Putrajaya) for detailed discussions.
